Faisal MIRZIA (born 07 10 2000) of Victoria Road, Edmonton, N18 2UF appeared at Highbury Corner Magistrates Court on the 11th April 2019, charged with four offences of selling counterfeit goods and possessing counterfeit goods for sale contrary to Section 92 of The Trademarks Act 1994. He pleaded guilty to all matters. He was sentenced to a fine of £100 and ordered to pay £50 towards prosecution costs and a £30 victims surcharge.
The case was brought by TM Eye as a private criminal prosecution on behalf of one of its well known luxury goods clients.
Mirzia ran a stall in Camden Green Market, Camden High Road, Camden, London, NW1 selling a wide variety of fake goods from various luxury goods brands including Michael Kors, Chanel, Miu Miu, Kenzo, Gucci, D&G and many others. No enforcement action action was taken in relation to these brands.
Camden Market and is open every day throughout the year. This is a popular area for tourists where the widespread sale of counterfeit goods is common place.
Between the 24th January 2019 and 12th February 2019, three test purchases were conducted from Faisel MIRZIA by detectives from TM Eye’s Dedicated Undercover Unit.
All of the purchases were covertly recorded and MIRZIA could be clearly identified from the relevant footage. This evidence led to the prosecution and conviction.
TM Eye Director David McKelvey said,”This is the latest conviction by TM Eye detectives of a criminal operating in the Camden High Road area. TM Eye has convicted over 60 persons in recent years in that specific area of Camden for similar offences. There has been a significant reduction in the open sale of fake goods of brands TM Eye represents with criminals deliberately avoiding them through fear of prosecution.
TM Eye will continue to target those who commit such criminality and will bring them to justice. Mirzia now has a criminal conviction and his fingerprints, photograph and DNA will be taken. The UK Border Agency have been informed in order to consider his immigration status.
