Jacqueline DAVIES of Heol Pillapall, Barry, Vale of Glamorgan appeared at Cardiff Magistrates Court on the 23rd May 2019, charged with four offences of selling counterfeit goods and possessing them for sale. She pleaded guilty to all matters. The court have required a financial circumstances enquiry to establish the profits made and assets of DAVIES prior to sentencing. DAVIES will appear again of the 10th June 2019 for sentence.

The case was brought by TM Eye as a private criminal prosecution on behalf of Pandora jewellery.

The prosecution and conviction follows a 9-month investigation by the TM Eye Online Investigations Team into a prolific Ebay seller using the name ‘bettieblue14’. A series of covert evidenced test purchases were made from the site which sold large quantities of fake Pandora jewellery items as genuine at a 50% discount.

The first test purchase took place on the 25th July 2018 of a charm advertised as “Genuine Pandora 1⁄2 PRICE SALE Poetic Blooms Dangle Charm”. This charm was advertised at the “Buy it Now” price of £16.99. The listing indicated that 8 of these charms were currently available and that 264 had previously been sold by the seller. A further posting by “bettieblue14” was also identified. This posting advertised a “Genuine Pandora 1⁄2 PRICE SALE Poetic Blooms Heart Charm”. This charm was advertised at the “Buy it Now” price of £18.99. Both charms were purchased at a total price of £35.98 with free Royal Mail 1st class postage. Both charms when examined were found to be counterfeit.

On 5 February 2019, the TM Eye Online Investigation’s Team identified a listing for a charm advertised as “Poetic Blooms Dangle Charm”. This charm was advertised at the “Buy it Now” price of £16.99. The charm was being advertised for sale by “bettieblue14”. A further posting by “bettieblue14” was also identified advertising a “Genuine Pandora 1⁄2 PRICE SALE Magnolia Bloom Enamel Charm and Pandora GiftPouch”. This charm was advertised at the “Buy it Now” price of £18.99. The listing indicated that 6 of these charms were currently available and that 111 had previously been sold by the seller.

On 21 February 2019, the TM Eye Online Investigations Team identified a further listing for a charm advertised as “Genuine Pandora FORGET ME NOT SPACER CZ charm & Pandora Gift Pouch”. This charm was advertised at the “Buy it Now” price of £17.99. The charm was being advertised for sale by “bettieblue14”. A further posting by “bettieblue14” was also advertised a “Genuine Pandora Silver Mother Mom Mum Charm & Pandora Gift Pouch”. This charm was advertised at the “Buy it Now” price of £19.99. The listing indicated that 5 of these charms were currently available and that 153 had previously been sold by the seller. Both charms were purchased at a total price of £37.98.

The eBay site appeared to suggest that in the time “bettieblue14” has been a registered eBayseller, since 27 February 2014, a total of 435 sales relating to “Pandora” products had been sold by this individual for a combined total of £6,645.69. During the test purchase operation it was demonstrated that 104 items were displayed for sale at any one time for a total of £1,622.02.

Following an investigation Jacqueline DAVIES was identified as the seller using the account ‘bettieblue14’. A criminal summons was issued and served leading to her appearance at court. She will be sentenced on the 10th June 2019.
