Asadullah SAHAR appeared at Highbury Corner Magistrates Court on 2 August 2018, charged with two (2) offences of selling counterfeit goods contrary to section 92 of The Trademarks Act 1994. He pleaded guilty to all matters and was sentenced to a Community Order with a 14 day curfew between 9pm and 6am. He was also required to pay an £85.00 Victims Surcharge.
The case was brought by TM Eye as a private criminal prosecution on behalf of a well known luxury brand.
TM Eye had previously prosecuted and convicted SAHAR on 23 August 2017 for six offences of selling counterfeit goods. He had pleaded guilty to all matters and had received a 12 Month Community Order to include 160 hours Unpaid Work and was ordered to pay £355.00 costs and an £85.00 Victims Surcharge. Despite this he continued to re offend and the new prosecution was brought.
SAHAR operated from a shop premises located at 245 High Street, Camden, NW1 called London Souvenirs. He sold a wide variety of fake goods from a large number of luxury brands including Michael Kors, Chanel, Miu Miu and many others. These brands were not the subject of any prosecution.
TM Eye Director David Mckelvey said, “SAHAR was targeted and convicted by TM Eye in 2017. Less than a year later he was selling fake goods again. TM Eye undercover operatives evidenced him selling counterfeit goods and carried out a series of test purchases. This evidence secured the new conviction.
Should SAHAR re offend he will likely risk a custodial sentence.”
