RESULT AT COURT
On 1st November 2012, Yu FENG of 109 Trelawney Estate, Paragon Road, Hackney E9 6PG appeared at Highbury Corner Magistrates Court and entered pleas of guilty to a number of Trade Mark Offences. The Court requested reports to be prepared on FENG and on Thursday 22nd November she was sentenced at Highbury Corner Magistrates Court to a 3 month Community Order; consisting of an 8 week long electronic tagged curfew between the hours of 10pm and 7am.
The case against FENG was the result of a covert operation by TM EYE. This included evidenced test purchases and surveillance, leading to enforcement action on Tuesday 9th October 2012, in partnership with Camden Trading Standards and Camden Police. FENG’s unit was raided and offences under the Trade Marks Act 1995 identified. FENG was arrested and taken to Kentish Town Police Station. FENG was later bailed to return for a later interview with Camden Trading Standards. A search of the unit led to the seizure of over 1,000 counterfeit items including Mulberry and Louis Vuitton.
Summonses were obtained and later served on Yu FENG for Trade Mark Offences relating to the earlier test purchases of fake MULBERRY and LOUIS VUITTON goods.
TM EYE Director David McKelvey said, ”FENG was part of an organised criminal network involved in the sale and distribution of counterfeit goods on a large scale at Camden Market. She openly sold fake goods. The potential harm to brand holders was significant. TM EYE have successfully prosecuted FENG in the criminal courts by a private criminal prosecution to ‘prevent and deter’ further offending. We will continue to ‘catch and convict’ those engaged in offences against our clients property.”
