Thomas Griffin MacDonald appeared at Barkingside Magistrates Court on 8th November 2018, charged with three offences of selling counterfeit goods contrary to Section 92 of The Trademarks Act 1994. He pleaded guilty to all matters and receive a 12 Month Conditional Discharge and was ordered to pay £1,500.00 costs and a £20 victims surcharge.


The case was brought by TM Eye as a private criminal prosecution on behalf of one of its luxury goods clients.


The case follows a three month covert investigation by TM Eye. MacDonald sold a variety of fake goods from his stall located at ‘Bonzer’ car boot sale. Covert test purchases of counterfeit goods were carried out between the 12th and 26th July 2018. Macdonald was covertly filmed selling counterfeit goods.


Macdonald will now have his fingerprints, photograph and DNA taken by police and the conviction recorded on the police National Computer. Should he re offend he will risk a custodial sentence.


 TM Eye has prosecuted over 450 criminal cases as a private prosecutor and has a 100% conviction rate. 13% of those convicted have received a custodial sentence.
