Castle sold fake goods on FACEBOOK

Tanya Castle of Cherwell Grove, South Ockendon, RM15 6BD appeared at Barkingside Magistrates Court on 4 February 2019, charged with four offences of selling counterfeit goods contrary to section 92 of The Trademarks act 1994. She pleaded guilty to all matters. She was sentenced to a £180.00 Fine and ordered to pay £500.00 Costs and a 30.00 Victim Surcharge. The court made a Forfeiture and Destruction order for all goods seized by TM Eye.

The case was brought by TM Eye as a private criminal prosecution on behalf of its clients Hugo Boss and MULBERRY.

Tanya Castle had been a member of Facebook since February 2007 and advertised goods for sale using profile names including ‘Tanya Castle’, ‘Erin Peters’ and ‘Gifts for all the Family at Bargain Prices’ as well as a number of Group Selling pages. She advertised multiple fake items bearing brand names such as Stone Island, Moncler, Ugg, Nike, Mulberry, Chanel, Hugo Boss and Armani.

The TM Eye Online Investigations Team carried out a series of online test purchases from Castle, with goods being collected by a detective from the TM Eye Dedicated Undercover Unit, supported by the surveillance team. All purchases were filmed covertly and formed the evidence leading to the prosecution and conviction.

TM Eye Director David Mckelvey said,”TM Eye has successfully prosecuted another criminal operating on the FACEBOOK social media site. Castle operated a substantial criminal business making significant profits. She now risks going to prison should she re offend”.
